1. About Spotena
Spotena (“we”, “us”, “our”) operates a live-streaming chat platform (the “Services”) that lets streamers embed an existing third-party live broadcast (e.g. a YouTube live video) and host a moderated chat alongside it. By accessing or using Spotena, you agree to this User Agreement.
If you do not agree, do not use the Services.
2. Eligibility & accounts
You must be legally able to enter a binding contract in your jurisdiction. You sign in with Google; you are responsible for activity on your account and for keeping your device secure.
Anyone may watch a stream and read public chat without an account. To send chat messages or to host a stream, you must be signed in. We may suspend or terminate accounts that violate these terms or harm other users or the platform.
3. Streamer (host) responsibilities
When you go live on Spotena, you confirm that you have all necessary rights to the underlying broadcast you embed (including the YouTube video) and to display it in the manner Spotena enables.
You are responsible for the content of your stream, the chat that occurs in your stream, and for using the host controls (including ending the stream) to comply with these terms.
4. Chat content & conduct
You retain rights to chat messages you post, but you grant Spotena a non-exclusive licence to display, transmit, and process them solely to operate the chat in real time. We do not retain chat after a stream ends.
You will not use Spotena for unlawful, harassing, hateful, threatening, sexually exploitative, fraudulent, or harmful activity; to distribute malware; to spam; or to circumvent moderation, rate limits, or security.
Spotena uses two-stage moderation (a wordlist filter and an optional asynchronous AI classifier). Moderation tools are imperfect; messages that pass moderation are not endorsed by Spotena.
5. Ephemeral chat & no retention
Chat is intentionally ephemeral. We do not write live chat messages to a database. When a stream ends, the entire chat room is dropped from server memory and any unrecorded messages are gone — by you, by the host, and by Spotena.
If you want a record of something said in chat, save it yourself before the stream ends. Spotena does not provide chat exports or recovery.
6. Beta & pricing
During beta the Services are provided at no charge. We may charge for hosting streams in the future. Pricing displayed in the product (including any list price shown alongside a discount) is illustrative; the price you actually pay is the price the product confirms at the moment you subscribe.
You are responsible for any taxes that apply to you. We may modify or discontinue features with notice where required.
7. Third-party content
Spotena embeds third-party media (such as YouTube videos) at the host’s direction. Use of those services is governed by the third party’s own terms (e.g. YouTube Terms of Service, Google Privacy Policy). Spotena is not responsible for the underlying broadcast or its availability.
8. Intellectual property
The Spotena name, logo, UI, and software are protected. Do not copy or misuse our branding or code except as allowed by law or written permission.
9. Disclaimers & limitation of liability
The Services are provided “as is” without warranties of any kind to the fullest extent permitted by law. We are not liable for indirect, incidental, special, or consequential damages, or for loss of profits or data, except where liability cannot be excluded by law.
10. Changes & termination
We may modify this Agreement or the Services. Continued use after changes constitutes acceptance where permitted by law. We may suspend or terminate access for breach or risk.
